Recent Developments in Intellectual Property Economic Damages

Since last summer, several appeals court decisions regarding intellectual property cases have reinterpreted, re-applied, and struck down some frequently used but seldom challenged techniques and approaches to economic damages. The overturned verdicts have erased damages awards in the billions of dollars and have put in motion dramatic changes to traditional damages assessments. In this paper, I propose to cover five key aspects of these recent developments: Profit Apportionment; Proximate Cause Revenues; 25 percent rule; entire market rule; and hypothetical license analysis
